1. About these terms
These Terms of Service govern your use of Present Agent (“we,” “us,” “our”) — the website at presentagent.vip and its subdomains, and any related services. By using the site, you agree to these terms. If you don't agree, please don't use the service.
2. What we do
Present Agent is an AI-assisted gift discovery service. We use Google Calendar and Google Contacts (with your permission) to detect upcoming occasions, and use large language models (Anthropic Claude and Google Gemini) to generate personalized gift recommendations from our curated product catalog. Recommendations are AI-generated and AI-assisted — they reflect the information you provide and the patterns we have learned, but they may not always match your recipient's actual preferences. Final gift decisions are yours.
We surface products from independent merchants and retailers via Shopify. We do not warehouse, ship, or fulfill orders directly — those are handled by the individual merchants.
3. Account creation and responsibilities
You sign in to Present Agent using your Google account via OAuth. You are responsible for maintaining access to your Google account and for all activity that occurs under your Present Agent session. Notify us promptly at support@presentagent.vip if you suspect unauthorized access. You may use most browse and gift-finder features without an account; an account is required to save recipients, view your occasions dashboard, or use the Calendar and Contacts integration.
4. Purchases & payment
Checkout is handled by Shopify on store.presentagent.vip. The contract for purchase is between you and the fulfilling merchant — Present Agent acts as a discovery and curation layer. Shipping, returns, refunds, and warranty terms are set by the merchant. See our Returns page for the practical guide.
5. Google permissions and data
When you connect your Google account, you grant Present Agent read-only access to your Google Calendar and Google Contacts (primary contacts and "Other contacts"). You can revoke this access at any time from your dashboard settings or directly at myaccount.google.com/permissions. Revocation removes our access immediately; we will stop fetching fresh data, but information already cached in our database will be subject to the retention policy in our Privacy Policy. We do not request Gmail access in v0 of the service.
6. Acceptable use
Don't use Present Agent to: (a) violate any law; (b) harass others; (c) attempt to disrupt or reverse-engineer our service; (d) scrape or republish our catalog without permission; (e) impersonate another person; (f) submit false or misleading information; or (g) attempt to manipulate our recommendation engine through adversarial inputs.
7. Intellectual property
The Present Agent name, logo, site design, curation process, and recommendation outputs are our property. Product listings, images, and brand names belong to the respective merchants and brands. You own the personal data you provide (recipient profiles, gift history, preferences). You may not copy or republish our content without permission.
8. Disclaimer of warranties
The service is provided “as is” without warranties of any kind, express or implied. We do not guarantee that:
- Occasion detections will be accurate — they depend on the quality and completeness of your Google Calendar and Contacts data
- AI-generated gift recommendations will match your recipient's actual preferences — they are assistive, not deterministic
- Any product will be in stock when you attempt to check out
- The service will be uninterrupted or error-free
9. Limitation of liability
To the fullest extent permitted by applicable law, Present Agent and its operators are not liable for indirect, incidental, special, or consequential damages arising from your use of the service — including but not limited to lost profits, missed occasions, or recipient dissatisfaction with a gift. Our aggregate liability for any claim relating to the service will not exceed the greater of the amount you paid us in the 12 months preceding the claim or CAD $100.
10. Indemnification
You agree to indemnify and hold harmless Present Agent and its operators from any claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising from: (a) your use of the service; (b) your violation of these terms; (c) your violation of any third-party rights, including intellectual property rights; or (d) any content you submit through the service.
11. Termination
We reserve the right to suspend or terminate your account and access to the service at our discretion, with or without notice, for conduct we believe violates these terms or is harmful to other users, us, or third parties. You may terminate your account at any time by contacting us at support@presentagent.vip.
12. Governing law
These terms are governed by the laws of the Province of Quebec and the federal laws of Canada applicable therein, without regard to conflict-of-law principles. Any dispute arising from these terms or your use of the service will be subject to the exclusive jurisdiction of the courts of Quebec.
13. Changes to these terms
We may update these terms from time to time. The “Last updated” date at the top of this page indicates when. Continued use of the service after changes means you accept the new terms.
